Terms and conditions

The rules of the road for buying and selling on Horsepower House.

Last updated 5 October 2026

1. About these terms

These terms apply to your use of Horsepower House (horsepowerhouse.com.au), operated by Established Agency ("we", "us"). By creating an account, listing a car or using the site, you agree to them. If you don't agree, don't use the site.

2. What we do — and don't do

Horsepower House is an advertising platform that connects buyers and sellers. We are not a party to any sale, we don't own, inspect or hold the cars listed, and we don't handle payments between buyers and sellers.

Any contract of sale is between the buyer and the seller only.

3. Your account

You must be 18 or over and give accurate details. You're responsible for everything done through your account, so keep your password secure. Tell us straight away if you think your account has been misused.

4. Listing a car

You must own the car or be authorised to sell it. Listings must be for a real car that is genuinely for sale, with honest, accurate descriptions, specs, photos and pricing.

Disclose modifications, engineering status, rego status, known faults, accident or write-off history, and any finance owing. Claims about power figures should state how they were measured (e.g. rwkw on a dyno).

Photos must be of the actual car and must be yours or used with permission. Mark your listing as sold once it's sold.

Dealers must comply with motor dealer licensing laws in their state and the Australian Consumer Law, including statutory warranties.

5. What's not allowed

Stolen, encumbered or misrepresented vehicles; fake, duplicate or bait listings; listings for parts-only, wanted ads or services unless we allow them.

Scams, phishing, requests for payment outside a genuine sale, or asking buyers to pay deposits for cars they haven't seen.

Abusive, discriminatory or spammy messages, and harvesting other users' contact details.

Promoting illegal modifications or street racing, or anything that breaches Australian law.

6. Buying safely

Always inspect the car in person and get an independent pre-purchase inspection. Run a PPSR check (ppsr.gov.au) to confirm the car isn't stolen, written off or under finance.

Check engineering certificates and compliance for modified vehicles in your state. Never pay a deposit or transfer money for a car you haven't seen, and be wary of deals that look too good to be true.

7. Content and licence

You keep ownership of the content you upload. You give us a non-exclusive, royalty-free licence to display, resize and promote your listings and photos on the site and in our marketing while they're listed.

The Horsepower House name, logo and site design belong to us. Don't copy, scrape or reuse them without permission.

8. Moderation

We may review, edit for formatting, hide or remove any listing or message, and suspend or close accounts that break these terms or that we reasonably believe put users at risk. Where we can, we'll tell you why.

9. Fees

Listing a car is currently free. If we introduce paid features such as featured listings or dealer subscriptions, prices and terms will be shown clearly before you pay.

10. Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law. To the extent the law allows, we aren't responsible for the accuracy of listings, the condition or legality of any car, or any loss arising from dealings between users.

Where our liability can't be excluded, it's limited to resupplying the service or the cost of doing so.

11. Changes and general

We may update these terms. Continuing to use the site after changes means you accept them. These terms are governed by the laws of Victoria, Australia.
